Last updated March 31st, 2018

At Deep Urban, we think the most important thing you need to know about our privacy policy is that it conforms to the Golden Rule, which means we don’t do anything with your private information that we wouldn’t want done with ours.

We will never willingly disclose your personally identifiable information to any third parties without your express permission.  We take everyone’s safety and privacy as a sacred trust, and we don’t sell your private information.  Period.

This Privacy and Cookie Policy is part of and is incorporated into this site’s Terms of Service.

Do you disclose my personal information?

We disclose personal information only as required by law or as required by the normal operation of our Site and/or Service.  For instance, when you purchase a painting, we may relay your information to a third party shipping service, or if you order one of our personalized gift products, we may relay your information to a merchant who produces those products.  In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.  However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by them. Currently, we use Stripe to process all of our payments.

Remember that certain providers may be located in, or have facilities that are located in a different jurisdiction than either you or us.  So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.  As an example, if you are located in the United States and your transaction is processed by a payment gateway located in Canada, then your personal information used in completing that transaction may be subject to disclosure under Canadian legislation.  Remember, once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or by our website’s Terms of Service, and we cannot be responsible for the policies of other sites, so we encourage you to read their Privacy Policies and Terms of Service, too.

If Deep Urban is acquired or merged with another company, your information may be transferred to the new owners.

How do you keep my information secure and safe?

Deep Urban stores an data it keeps about you and your transactions on a secure server behind a firewall.  If you make a purchase on Deep Urban and you choose a direct payment gateway to complete your purchase, your transaction data, exclusive of credit card or or payment account number, is stored by Deep Urban, but no person at Deep Urban ever sees your credit card data, and it is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) by our credit card processor(s).  All direct payment gateways we use adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our site and its service providers.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Yes, we use cookies to personalize and remember your experience with us.  They also help us learn more about how people use our site.  But they don’t store things like your name or credit card numbers–nothing personally identifiable.  So, while we think cookie use is no big deal, you might disagree. And sites that we link to, like Facebook, Twitter, and YouTube, might use cookies and might use them differently from how we do (and we have no control over those). By using this site, you agree to our use of cookies, and you also agree that this Privacy and Cookie Policy is in effect no matter what sort of device you use to access this site.  If you want to control what cookies are placed on your devices, you may be able to use the links below to learn how to do so, but keep in mind that if you disable cookies, things might not work as you need them to on this site and others.

International Users

If you use Deep Urban from outside of the United States, by using the Site, you give consent to the transfer of your information in the United States and to our collection, use, and maintenance of your information in accordance with this Privacy Policy.

What about changes to this policy?

You can easily see when this Privacy Policy was last updated by looking near the top of the page.  We reserve the right to modify the Policy at any time, and changes take effect immediately upon their posting on this web page, so please review it and our Terms of Service frequently so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose your information.

Are there special statements for users in California?

Aren’t there always?  🙂  We think this is overkill, but we want to comply with California Civil Code Section Section 1798.83, so here goes: we will not disclose your personal information to third parties for their use in direct marketing without your consent.  You have the right to opt in to such disclosure of your personal information (though we have no idea why California seems to think you might want to).  And, of course, you also have the right to opt out.  Either way, you can do so by sending us an email and writing “California Privacy Compliance” in the subject line.

And finally …

We want you to know we won’t knowingly disappoint you.  At Deep Urban, we believe in the Golden Rule, and we’ve crafted this Privacy Policy with that principle in mind.  We treat your private information with as much care as we do our own.  And that truly is the bottom line.
